1. Agreement to Terms

Crest Web Studio provides web design, web development, SEO, and website maintenance services for small businesses. The specific scope, timeline, deliverables, and pricing for each project will be outlined in a separate project proposal or agreement signed by both parties before work begins.

3. Client Responsibilities

When engaging our services, you agree to:

  • Provide accurate and complete information about your business and project requirements
  • Supply requested content (text, images, logos) in a timely manner
  • Review and provide feedback on deliverables within agreed timeframes
  • Make payments according to the agreed payment schedule
  • Ensure that any content you provide does not infringe on third-party rights

4. Payment Terms

Payment terms are specified in each project agreement. Standard terms include:

  • A deposit (typically 50%) is required before work begins
  • The remaining balance is due upon project completion, before final deployment
  • Maintenance plans are billed monthly in advance
  • Late payments may incur a fee of 1.5% per month

All prices are in USD unless otherwise specified.

5. Intellectual Property

Your content: You retain ownership of all content (text, images, logos) you provide to us. You grant us a license to use this content solely for the purpose of completing your project.

Our work: Upon full payment, you receive ownership of the custom design and code created specifically for your project. We retain the right to showcase the completed project in our portfolio unless otherwise agreed in writing.

Third-party assets: Stock photos, fonts, icons, and third-party plugins used in your project are subject to their respective licenses. We will inform you of any ongoing licensing requirements.

6. Revisions & Scope

Each project tier includes a specified number of revision rounds as outlined in the project proposal. Additional revisions or changes that fall outside the agreed scope will be quoted separately. We will always notify you before performing work that exceeds the original scope.

7. Project Timeline

We will provide an estimated timeline for your project. While we make every effort to meet deadlines, timelines may be affected by factors including delayed content delivery, extended review periods, or scope changes requested by the client. We will communicate any timeline changes promptly.

8. Warranties & Disclaimers

We warrant that our services will be performed in a professional and workmanlike manner. However:

  • We do not guarantee specific business outcomes (such as increased sales or traffic)
  • We do not guarantee uninterrupted website availability (this depends on hosting providers)
  • Our services are provided “as is” without warranties beyond those expressly stated

9. Limitation of Liability

To the maximum extent permitted by law, Crest Web Studio's total liability for any claim arising from our services shall not exceed the total amount paid by you for the specific project in question. We shall not be liable for indirect, incidental, consequential, or punitive damages.

10. Termination

Either party may terminate a project agreement with written notice. Upon termination:

  • You are responsible for payment for all work completed up to the termination date
  • Deposits are non-refundable once work has commenced
  • We will provide all completed deliverables and source files for work already paid

11. Website Usage

When using our website, you agree not to:

  • Use the website for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the website
  • Interfere with the website's operation or security
  • Scrape or collect data from the website without permission

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved through good-faith negotiation first, followed by binding arbitration if necessary.

13. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated through our website. Continued use of our services after changes constitutes acceptance of the updated terms.
